DENVER BUSINESS JOURNAL - The U.S. Court of Appeals for the Second Circuit affirmed that Apple Inc. conspired with several publishers to set prices on eBooks.
The court rejected Apple Inc.'s challenge to the ruling in State of Texas, et al. v. Penguin Group (USA) Inc., et. al. Instead, the appellate court affirmed the lower court's finding that Cupertino, California-based Apple (NASDAQ:AAPL) conspired with several publishers to set prices on eBooks, an agreement that raised prices for consumers.
Colorado was one of the original states to pursue antitrust allegations against Apple and the publishers as a part of a multistate team. Former Attorney General John Suthers said then that about 2 percent of eBook purchases were made by Colorado consumers.
